A will is a critical document that explains in detail how your assets are to be distributed upon your death. A will explains to who the assets are to be distributed to, and you can also establish a guardianship for any minor children. If one passes away without a legal and valid will, state law and the courts in Florida will determine how to distribute the estate. Dying intestate, without a legal and valid will, means that your assets maybe distributed in a manner that may not have been what you intended or wished for.
When a will is drafted or modified, your assets must be reviewed thoroughly and your specific objectives must be reviewed to ensure that the will articulates your wishes and is legally valid.
Some things that you must keep in mind:
A will does not help manage a person's affairs if incapacity takes place.
A will is not effective and legally effective until after death.
A will may be changed or amended by the testator by drawing a new will or by attaching a "codicil," which simply means an addition or amendment executed by the testator with the same legal formalities of a will. In other words, the term(s) on a will cannot be changed by writing something in or crossing something out after the will is executed.
If you already have a valid Florida Will in place, it is always wise to have it reviewed when your circumstances have changed. Divorce or remarriage, additional children and/or stepchildren, an increase or decrease in your property and assets are just a few excellent reasons to revisit and amend your will.
